The Chandler Police Department completed its investigation into Trigg’s May 18 death and recommended a Class 4 felony charge of child abuse against Brady Kiser.
The case has been submitted to the Maricopa County Attorney's Office for review.
Trigg died six days after being found unconscious in a backyard pool. The drowning occurred at Kiser’s home, and Trigg was hospitalized in critical condition until his death.
Brady Kiser mentioned being distracted by their infant son when Trigg went outside to play. He lost sight of Trigg for a few minutes and found him unconscious in the pool when he checked on him.
Brady Kiser called 911 as his wife was out with friends at the time.
Emilie Kiser, known for her content on TikTok and Instagram, has not publicly commented on her son's death. In May, she filed a lawsuit to keep records of her son's death private. The release of records was temporarily blocked by a judge last month.
Her attorney did not comment immediately.
