Minister Warns of Legal Case Impact on Asylum Seekers and Homeless

Justice Minister Jim O’Callaghan stated that a court decision may allow asylum seekers to claim damages from the State for lack of accommodation, while homeless individuals might not have the same opportunity. This refers to two asylum seekers who were left without beds by the State.

O’Callaghan expressed concerns about the potential disparity in compensation between asylum seekers and homeless people. He anticipated that the European Court of Justice would grant the two asylum seekers the chance to seek damages.

Speaking at the Institute of International and European Affairs, O’Callaghan discussed the challenge of balancing human rights, particularly in accommodating asylum seekers in Ireland. He rejected the idea of building holding centers for asylum seekers and instead proposed using larger properties for this purpose.

He also addressed the issue of deportation flights, describing them as a necessary correction. The government is preparing to revamp the asylum system, but concerns have been raised about potential legal challenges and human rights violations.

O’Callaghan emphasized the need for a more efficient international protection system to reduce delays in decision-making. He acknowledged the negative portrayal of migrants and asylum seekers in the media and stressed the importance of a rules-based system in international protection.
