Security Agency Owner Sentenced for Failing to Pay SSS Contributions
In Cebu City, the owner of a security agency was sentenced to over three months in prison for not remitting Social Security System (SSS) contributions deducted from an employee's salary. The court found the owner guilty of estafa due to the non-payment of around P13,242.25 in SSS deductions.
An owner of a security agency in Cebu City was sentenced to three months and 11 days in prison for failing to remit Social Security System (SSS) contributions deducted from an employee's salary. Arne Aballe Sarsalejo was found guilty of estafa under Article 315, Paragraph 1(b) of the Revised Penal Code by the Municipal Trial Court in Mandaue City.
The court based the penalty on the alleged damage of P2,250, even though the total deductions amounted to P13,242.25. The complainant, Junebeb T. Clatero, a former security guard, reported that his SSS contributions were not remitted from February 2018 to March 2022.
Although the agency eventually paid, the delay caused temporary prejudice, constituting damage in estafa. According to the law, failure to remit SSS deductions within 30 days of the due date can lead to penalties as per the Social Security Act of 2018.
