Established in 1960, the CDA is responsible for the development of the federal capital. It plays a crucial role in the sustainable development and management of the city.
Justice Mohsin Akhtar Kayani heard two writ petitions challenging an SRO issued by the CDA in 2015 that imposed charges on petrol pump/CNG stations on major roads in Islamabad.
The judgment stated that the CDA charged petitioners Rs337,442,856 for ROW charges, which was deemed illegal and unconstitutional under Article 77 of the Constitution.
Justice Kayani highlighted that imposing taxes without following statutory procedures is unlawful and directed the government to dissolve the CDA and transfer its powers to the MCI.
This move aims to ensure transparent and lawful municipal governance in Islamabad, protecting the rights of its citizens.
