India Rejects Arbitration Court Under Indus Treaty as 'Illegal'
India has dismissed the Court of Arbitration under the 1960 Indus Waters Treaty as illegal, rejecting its authority. The ministry of external affairs snubbed the 'supplemental award' by the court for asserting its jurisdiction over hydropower cases in Jammu and Kashmir. India has suspended the treaty until Pakistan stops supporting cross-border terrorism.

India has rejected the Court of Arbitration under the 1960 Indus Waters Treaty as illegal, dismissing its authority. The ministry of external affairs stated that the court's constitution violated the treaty. The supplemental award by the court was deemed illegal and void by India. The Indus Waters Treaty allocates the waters of the Indus Basin between India and Pakistan. India has the right to use the water of western rivers for domestic use, irrigation, and hydro-electric power generation, but has not fully utilized its share due to lack of storage capacity.
After a terrorist attack in Pahalgam, India suspended the treaty until Pakistan stops supporting cross-border terrorism. A neutral expert upheld India's position on the Kishenganga and Ratle projects. The World Bank had allowed India to construct hydroelectric power facilities on certain rivers under the treaty. India has the right to create water storage capacity on western rivers and harness power from them, but has not utilized it fully.
