Kilmar Abrego Garcia to be Released from Jail in Tennessee

Kilmar Abrego Garcia is expected to be released from jail in Tennessee on Wednesday, only to be taken into immigration custody. The Salvadoran national, whose mistaken deportation sparked controversy over President Donald Trump’s immigration policies, has been in jail since his return to the U.S. on June 7, facing two counts of human smuggling.

U.S. Magistrate Judge Barbara Holmes ruled on Sunday that Abrego Garcia does not have to stay in jail before his trial. His conditions of release will be set on Wednesday afternoon, but he is expected to be taken into custody by U.S. Immigration and Customs Enforcement after his release on criminal charges.

Abrego Garcia’s wife, Jennifer Vasquez Sura, expressed the challenges they faced since his separation from the family by the Trump administration. She mentioned the missed family events and the support they received from the community, their faith, and love.

Federal prosecutors are appealing Holmes’ release order, concerned that Abrego Garcia might be deported before his trial. Abrego Garcia pleaded not guilty to smuggling charges related to a 2022 traffic stop in Tennessee. Despite living in the U.S. for over a decade with his American wife and children, ICE plans to detain him.

Although he can’t be deported to El Salvador due to gang threats, he could be sent to a third country if that country agrees not to send him back to El Salvador.
