A federal judge in New Hampshire has issued a new nationwide block against President Donald Trump’s executive order seeking to end birthright citizenship. US District Judge Joseph Laplante granted a request to certify a nationwide class that will be comprised of those deprived of citizenship, blocking Trump’s order from being enforced against born and unborn babies impacted by the policy. Laplante's ruling could be a critical bulwark against Trump’s policy as other courts reevaluate their decisions in light of the Supreme Court’s ruling. The judge will pause his order to allow the Trump administration time to appeal.

In February, Laplante had blocked the order only against members of nonprofit groups. Several judges have ruled Trump’s order unconstitutional, prompting a series of appeals. Laplante’s ruling focused on certifying a class of individuals affected by the order, excluding parents. The judge noted the urgency of the litigation and the impracticality of conducting discovery before granting class certification.

Class action lawsuits require class representatives, including a Honduran asylum-seeker and a Brazilian man. The executive order, signed by Trump in January, restricts citizenship for children born to parents in the country unlawfully. The Supreme Court ruled that the administration cannot enforce the order for 30 days but can develop guidance on implementation.

Lower courts are considering how the Supreme Court’s ruling impacts nationwide injunctions in other cases challenging Trump’s order. More court proceedings are expected in the coming days and weeks.
