Assault Charge Against Law Professor Diarmuid Phelan Dismissed by Judge

A judge has dismissed an assault charge against law professor and barrister Diarmuid Phelan, stating that he would not receive a fair trial.

Mr Phelan (57), who teaches at Trinity College Dublin, appeared before Judge William Aylmer at Wexford District Court. The charge was related to an alleged assault on his neighbor Kevin McHale in Co Wexford in August 2021.

The case faced delays, and Mr Phelan was not informed of the complaint until later. His defense argued that critical video evidence was not available due to the delayed notification.

Mr Phelan denied the assault, claiming self-defense. The court heard about a history of disputes between Mr Phelan and Mr McHale over land trespassing.

Judge Aylmer ruled in favor of Mr Phelan, citing the absence of CCTV footage and the lack of a fair trial possibility. The assault charge was dismissed.
