A nurse who objected to sharing a female changing room with a transgender woman doctor has been cleared of gross misconduct allegations. Sandie Peggie, a nurse for over 30 years, claimed she faced unlawful harassment when asked to share a changing room with Dr. Beth Upton. Upton complained about Peggie's behavior after an incident at Victoria hospital in December 2023. Peggie was accused of misconduct, patient care failures, and misgendering Upton. However, NHS Fife stated that there was insufficient evidence to support misconduct.

Peggie's solicitor expressed her relief at the outcome after an 18-month internal process. NHS Fife and Upton are in an ongoing employment tribunal case. The tribunal is significant due to a recent supreme court ruling on the legal definition of a woman in the Equality Act 2010.

Peggie felt embarrassed and intimidated during the incident with Upton. NHS Fife's equality lead mentioned providing advice on accommodating trans staff based on the Equality and Human Rights Commission's code of practice.

As the tribunal progresses, there are differing views on the matter. The first minister supports NHS Fife, while others urge a settlement to end the saga.
